PenRUSH — Terms of Use

1.Who we are.
PenRUSH is published by Uri Zohar, an Israeli licensed exempt dealer (Esek Patur) (the “Publisher”, “we”). Contact: [security/contact email — to be set at D-12].
2.The software is free and open source.
PenRUSH is licensed to you under the Apache License 2.0, not sold. Your rights to use, copy, modify, and redistribute the software come from that license, not from these terms. If anything here conflicts with the Apache License 2.0 regarding the software itself, the license wins.
3.No account, no data.
You do not need an account, an email address, or a payment method to download PenRUSH. This site does not collect, store, or transmit personal data, does not set cookies, and contains no telemetry. Downloads are served from GitHub Releases; GitHub’s own privacy terms govern GitHub’s infrastructure logs, which we never receive.
4.No warranty — read this one.
PenRUSH is provided “AS IS” and “AS AVAILABLE”, without warranties or conditions of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement (Apache License 2.0, Section 7). PenRUSH is a risk-reduction tool. It does not and cannot guarantee that any software you install is safe, and it will not catch every supply-chain attack. A passing gate result is not a safety certification. You remain responsible for what you install and run.
5.Limitation of liability.
To the maximum extent permitted by applicable law, and as set out in Section 8 of the Apache License 2.0, the Publisher and contributors are not liable for any damages arising from your use of, or inability to use, PenRUSH or this site — including lost data, lost profits, or losses caused by software that PenRUSH failed to flag. Where applicable law does not permit this exclusion (including mandatory consumer-protection rules in your country of residence), liability is limited to the greatest extent that law allows. Nothing in these terms excludes liability that cannot lawfully be excluded.
6.Acceptable use of this site and the PenRUSH name.
You may not: (a) interfere with or disrupt this site or the release infrastructure; (b) redistribute modified binaries under the PenRUSH name or in a way that misrepresents provenance — the Apache License 2.0 grants no trademark rights (Section 6); (c) remove or falsify release signatures, checksums, or provenance attestations when redistributing official binaries; (d) use the software or this site in violation of laws that apply to you, including computer-misuse, sanctions, and export laws. These are terms for the site and brand; they do not restrict your Apache-2.0 rights in the source code.
7.No support obligation.
We may publish updates, advisories, and documentation, but we owe you no support, maintenance, updates, or response times. Paid support, if ever offered, will be under a separate agreement (Apache License 2.0, Section 9).
8.Export and sanctions.
The software is published from Israel as publicly available open-source software. You are responsible for compliance with the import, export-control, and sanctions laws that apply to you, and you affirm you are not prohibited by applicable sanctions from receiving software from us.
9.Changes.
We may update these terms; the version published here at the time you download governs that download.
10.Governing law.
These terms are governed by the laws of the State of Israel, and disputes belong to the competent courts of Tel Aviv-Yafo — except that if you are a consumer, mandatory consumer-protection law and jurisdiction rules of your country of habitual residence remain unaffected.
11.Severability.
If any clause is unenforceable, the rest stand.
